1. Introduction
Welcome to Afini (hereinafter, the "Service"), operated by Bilbao AI S.L., a company established in accordance with the laws of Spain, with tax ID B-13759758, domiciled at Calle Diputación 8, floor 4, Department 5, 48008 Bilbao (hereinafter, the "Company").
These Terms and Conditions of Contract (hereinafter, the "Terms") regulate access to and use of services available on test.afini.ai and afini.ai, as well as any subdomain or extension thereof.
By accessing and using the Service, you fully accept these Terms. If you do not agree with any part, we ask you not to access or use the Service.
2. Description of services
2.1. Big Five personality tests (test.afini.ai)
Afini offers psychometric tests based on the Five Factor Model of Personality (Big Five, IPIP-NEO) in three levels of depth:

The Service includes a personalized report with results, charts and interpretations, which may include a narrative analysis generated through artificial intelligence.
2.2. Cognitive profile platform (afini.ai)
The afini.ai platform offers a comprehensive cognitive profile service through subscription, which includes:
- Additional psychometric assessments to Big Five (attachment, humor, values, time perspective, cognitive style — as the service evolves).
- Automatic compilation of a multilayered cognitive profile from assessment results.
- Personalized interaction with an AI model that uses the user's profile as context.
- Periodic profile recalibration through new assessments or conversational modules.
- Optionally, download of cognitive profile in portable format (JSON).
2.3. Upgrades (test.afini.ai)
A user who has completed a less comprehensive test may upgrade to a higher version, paying only the price difference. Previously recorded responses are automatically migrated, so the user only answers additional items.
3. Access, purchase and payment
3.1. Products and pricing
Prices for tests and subscriptions are expressed in euros (€) with taxes included when applicable. The Company reserves the right to update prices, with current prices at the time of purchase or contracting applying.
3.2. Payment and processing
Payments are processed through Stripe, a secure payment processing platform certified to PCI-DSS Level 1 standard. The Company does not store credit card data on its servers; all financial information is handled directly by Stripe.
Upon completing a transaction, you agree to be charged the indicated amount in your local currency (if applicable, with conversion by Stripe's exchange rate).
3.3. Invoicing
Transactions on test.afini.ai are documented through a simplified invoice in accordance with article 7 of Royal Decree 1619/2012, which is issued without requiring identifying personal data from the buyer (neither tax ID nor contact data). These simplified invoices ensure that no identifiable person is linked to the completion of a psychological test.
Subscriptions to afini.ai are billed monthly through Stripe. Users may manage their billing and obtain complete invoices from their account panel.
If you need a complete invoice for any service, you may request one by writing to info@afini.ai.
3.4. Access via voucher
The user may access the test service through an invitation code (voucher) provided by an authorized third party. Vouchers may offer free access or discounted access (percentage or fixed amount). By redeeming a voucher, the user accepts these Terms under the same conditions as a direct purchaser.
4. Subscription model (afini.ai)
4.1. Plans
The afini.ai platform operates under a monthly subscription model. Current plans, their characteristics, prices and usage limits are published on the platform itself. Aspects that may vary between plans include: the AI model used, monthly usage volume (measured in output tokens generated), profile recalibration frequency and portable profile availability.
4.2. Automatic renewal
The subscription renews automatically each month. Charges are made through Stripe to the payment method registered by the user. The user may cancel automatic renewal at any time from their user panel, effective at the end of the current billing period.
4.3. Usage limits
Each plan establishes a monthly usage limit for the AI service, expressed in output tokens generated. When the user reaches 80% of their monthly quota, they will receive an informational notification. Upon reaching 100%, the AI interaction service will be paused until the start of the next billing period.
Limits reset automatically at the start of each new monthly period. The user may check their consumption at any time from their account panel.
4.4. Plan changes
The user may change plans at any time. Changes to a higher plan apply immediately with proration. Changes to a lower plan apply at the start of the next billing period.
5. Your account and responsibilities
5.1. User data
To access the test (test.afini.ai), you must provide certain demographic data: name (required), age (required for calibration), biological sex (required for calibration), country (required), email (optional, for report sending), gender identity (optional) and pronoun preference (optional).
To create an account on afini.ai, you need to provide a valid email address and a name or pseudonym. Authentication is via magic link: a secure and single-use access link sent to your email. Passwords are neither used nor stored.
This data is used exclusively for: providing results calibrated to your demographic profile, applying reference norms specific to age and sex group, compiling your cognitive profile, personalizing AI interaction, and sending you transactional communications.
5.2. User responsibility
You are responsible for:
- Providing truthful and accurate information.
- Answering assessments honestly and thoughtfully.
- Keeping your token/access link and account credentials confidential.
- Not sharing your access with third parties.
- Using the AI service responsibly, without attempting to generate unlawful or harmful content.
6. Intellectual property rights
6.1. Company content
All Service contents, including texts, graphics, logos, images, data structures, calculation algorithms, profile compilers, prompt engineering, system prompts, narrative reports and interfaces are intellectual property of the Company or its licensors. They are protected under Spanish and international copyright law.
6.2. License of use
By purchasing test access or contracting a subscription, you are granted a personal, non-exclusive, revocable and non-transferable license to complete questionnaires, access your results, use the AI interaction service (if applicable) and download your portable profile (if your plan includes it). You cannot:
- Reproduce, distribute or publish assessment items without authorization.
- Create derivative works based on algorithms, norms or profile compilers.
- Use the Service for commercial or research purposes without prior agreement.
- Reverse engineer the code, algorithms or system prompts.
- Redistribute, resell or sublicense Service access.
6.3. Psychometric instruments
The IPIP-NEO questionnaire is in the public domain. However, Afini's implementation (interface, reference norms, calculation algorithms, narrative reports, profile compiler) is original work protected by Company copyright.
Other instruments integrated into afini.ai are used under license from their respective authors or are instruments designed by Afini based on scientific theories in the public domain.
6.4. Portable profile
The portable profile (JSON file), once purchased, is the user's property for personal use. Injection instructions, technical documentation and format schema remain under Afini's intellectual property.
7. Limitation of liability
7.1. Psychometric and informational nature
This Service offers standardized psychometric assessments based on validated scientific models. Results are statistical indicators reflecting your responses to questionnaires. The Service DOES NOT constitute a clinical, psychological or medical diagnosis nor replaces professional evaluation.
The AI interaction available on afini.ai IS NOT a therapy service, psychological counseling or counselling. If you require a clinical psychological evaluation, consult a licensed professional.
7.2. Disclaimer of warranties
The Service is provided "as is" without express or implied warranties of: absolute accuracy of results, continuous availability (without interruptions), suitability for a specific purpose, nor legal or professional validity of reports.
7.3. Civil liability limit
To the maximum extent permitted by law, the Company is not liable for: indirect, incidental, special, punitive or consequential damages; loss of profit, data or Service interruption; damages arising from decisions based on results or AI interaction; errors or inaccuracies in reports or AI model responses (within reasonable statistical margins and inherent limitations of language models).
For individual purchases (test.afini.ai), the Company's total liability to you does not exceed the amount paid in the transaction.
For subscriptions (afini.ai), the Company's total liability to you does not exceed the amount equivalent to three months of the contracted plan.
8. Cancellation and refunds
8.1. Right of withdrawal — Tests (14 days)
In accordance with article 103.a) of the TRLGDCU and article 16.a) of Directive 2011/83/EU, the right of withdrawal does not apply once the test is started. If you have made payment but have not yet started the test (have not answered any item), you may request a full refund by writing to info@afini.ai within 14 calendar days of purchase.
8.2. Right of withdrawal — Subscriptions (14 days)
For subscriptions, you have 14 calendar days from initial contracting to exercise the right of withdrawal, provided you have not completed any assessment or used the AI interaction service during that period.
8.3. Subscription cancellation
You may cancel your subscription at any time from your user panel. Cancellation takes effect at the end of the current billing period. No prorated refunds will be issued for partial periods, unless applicable law requires it.
8.4. No refund after service use
Once you have started a questionnaire or used the AI interaction service, the purchase or monthly fee is non-refundable. You may pause and resume a test at any time within your token's validity (30 days).
8.5. Technical errors
In case of technical error preventing assessment completion or result retrieval, Afini will offer the user the option to retake the assessment at no cost or receive a full refund.
8.6. Refund request
To request a refund, contact info@afini.ai providing your token or purchase reference. The refund will be processed within 10-15 business days to the same payment method used.
9. Privacy and personal data protection
Treatment of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. We recommend reading it in full before using the Service.
In summary:
- We collect demographic data, assessment responses, scores and cognitive profile.
- Your financial data are managed exclusively by Stripe (PCI-DSS Level 1).
- DO NOT sell your data to third parties.
- DO NOT use your data for advertising or marketing.
- DO NOT collect IP, browser fingerprint or geolocation data.
- The main legal basis is contract execution (art. 6.1.b GDPR).
- You may exercise your GDPR rights (access, rectification, deletion, portability, opposition) by writing to info@afini.ai.
- We retain data for the strictly necessary periods (see Privacy Policy for details).
10. Use of artificial intelligence
10.1. Report generation (test.afini.ai)
Narrative personality reports may be generated in whole or in part through a large language model (LLM). Content is based exclusively on the user's scores and the Big Five scientific model. The report does not constitute a clinical diagnosis.
10.2. Personalized interaction (afini.ai)
The AI interaction service uses the user's cognitive profile as context to personalize language model responses. You expressly consent to this injection when activating the service.
AI service limitations:- AI model responses may contain inaccuracies or unverified information. You should exercise your own judgment.
- The AI service does not substitute professional advice of any kind (medical, legal, financial, psychological).
- Conversation content is not persistently stored or used to train AI models.
- Afini does not guarantee continuous availability of the AI service, which depends on the model provider's infrastructure (Anthropic).
10.3. Transparency
You will be informed at all times that you are interacting with an AI system, in accordance with Regulation (EU) 2024/1689 (AI Act). You may view your cognitive profile composition and request that it not be injected into the AI model.
11. Prohibited conduct
You cannot use the Service for:
- Distributing or reproducing assessment items without authorization.
- Attempting to access unauthorized systems (hacking, injection, etc.).
- Sending spam, malware or malicious content.
- Impersonating identity or creating fraudulent access.
- Massively extracting data (scraping, bots).
- Bypassing security restrictions, access limits or usage quotas.
- Using the Service commercially without prior agreement.
- Generating unlawful, harmful or defamatory content or content violating third-party rights through AI interaction.
- Attempting to extract, replicate or reverse engineer system prompts, profile compilers or Afini algorithms.
- Violating laws, regulations or third-party rights.
The Company reserves the right to suspend access, cancel purchases or subscriptions and report unlawful conduct to competent authorities.
12. Suspension and termination
12.1. Suspension cause
The Company may suspend your access without prior notice if: you breach these Terms, incur in fraudulent or unlawful conduct, put Service security at risk, or fail payment obligations.
12.2. Termination
You may stop using the Service at any time. Termination of your access does not affect purchases already made, which remain valid.
The Company may discontinue the Service in whole or in part with 30 days' notice (except for security or legal reasons). In case of subscription service discontinuation, active users will receive prorated refund for the unused period and a reasonable timeframe to download their profile and results.
13. Changes to these Terms
The Company may update these Terms at any time. We will publish changes on this page with the update date.
For users with active subscription (afini.ai), substantial changes will be notified with a minimum of 15 days' notice by email. Continued use of the Service after changes take effect implies acceptance of the new Terms. If you disagree, you must stop using the Service and, if applicable, cancel your subscription.
14. Applicable law and jurisdiction
These Terms are governed by Spanish law and applicable regulations, including GDPR, LSSI-CE, TRLGDCU, Artificial Intelligence Regulation (AI Act) and Civil Code.
Any dispute arising from these Terms or Service use will be resolved by the competent courts of Bilbao, Vizcaya, Spain, unless specific consumer rights apply under law.
If you are a consumer (end user), you may access extrajudicial dispute resolution in accordance with Spanish law (mediation, consumer arbitration) and the ADR Platform for EU users.
Safeguard for consumers: The foregoing is understood without prejudice to the inalienable rights recognized by current legislation to consumers in all jurisdictions, including the right to submit to the courts of their domicile.15. Contact

16. Final provisions
16.1. Severability
If any provision of these Terms is declared invalid or inapplicable, the remaining provisions remain in force.
16.2. Complete agreement
These Terms, together with our Privacy Policy, Cookie Policy and Legal Notice, constitute the entire agreement between you and the Company regarding the Service, superseding any prior agreement.
16.3. No waiver
Lack of exercise of a right or claim by the Company does not constitute waiver of that right.
16.4. Language
These Terms and Conditions are available in Spanish and other languages. In case of discrepancy, the Spanish version prevails.
